Dear Attorney General Kobach:

I am writing to you today to request your assistance in a matter involving the Kansas Department of Insurance (KDOI). I have filed a complaint with KDOI against my insurance company, Homesite Indemnity Co., but KDOI has refused to investigate my complaint.

The complaint I filed with KDOI alleges that Homesite Indemnity Co. has engaged in unfair and deceptive practices by denying my claim for homeowners insurance benefits. I believe that Homesite Indemnity Co.'s actions have violated Kansas law, and I am requesting your assistance in ensuring that KDOI takes appropriate action to protect consumers from unfair and deceptive practices by insurance companies.

The Kansas Insurance Code, K.S.A. 40-101 et seq., sets forth the duties and responsibilities of KDOI. K.S.A. 40-102(a) states that KDOI is "charged with the administration and enforcement of the insurance laws of this state." K.S.A. 40-102(b) further states that KDOI is "authorized to investigate and take appropriate action to enforce the insurance laws of this state."

In my case, KDOI has refused to investigate my complaint against Homesite Indemnity Co. I believe that KDOI's refusal to investigate my complaint is a violation of K.S.A. 40-102(a) and (b). I am requesting your assistance in ensuring that KDOI takes appropriate action to investigate my complaint and protect consumers from unfair and deceptive practices by insurance companies.

I have attached a copy of my complaint to this letter.
