Kansas Insurance Commissioner Vicki Schmidt Claims to Advocate for Residents, but Ignored Insured When They Sought Help
Vicki Schmidt, Kansas Insurance Commissioner, claims her department is there to advocate for Kansans. However, when a Kansas resident sought help from the department, they were ignored and their case was not resolved.
Lonnie LuPardus, Kansas resident, sought the assistance of the the Kansas Insurance Department between December 2021 to present day after his insurance company Homesite Insurance (Progressive Home by Homesite), which is owned by American Family Insurance, denied his claim(s) related to property damage, theft, loss of use, and breach of the duty to defend; all of which LuPardus has coverage for. LuPardus had provided all of the necessary documentation to the Department, but the Department actively ignores LuPardus, even going as far as threatening LuPardus with legal action should he contact them again with complaint information.

LuPardus has they tried to contact the department multiple times that have resulted in no action. LuPardus even traveled almost 200 miles to attend a "pop-up" the Department held in order to speak to the Commissioner concerning his claims. Once LuPardus introduced himself to the Commissioner, she actively avoided LuPardus by hiding behind her staff and directly avoiding LuPardus in anyway she could. LuPardus wishes to notate that there was a total of 5 people at the "pop-up" not including the 10+ employees of the Department. All of which ignored LuPardus at every opportunity.
LuPardus also staged a one-man protest outside the Department in freezing temperatures for several hours, only to be mocked by Department employees who came out to laugh and snap photos of him during his protest. "Instead of inviting me in to discuss the issues to see if common ground could be found, the Department chose to ignore me in below freezing weather while actively mocking me with the taking of photos of me during my last resort protest. These people and Commissioner Schmidt don’t give a fuck about you."
LuPardus has been forced to work on these claims full time for the past two years with no help from any agency, which has resulted in out of pocket expenses in the thousands of dollars . LuPardus is frustrated and disappointed with the Kansas Insurance Department's lack of response.
"I feel like I've been completely abandoned," the resident said. "I don't understand why the Kansas Insurance Department, who try to push their bullshit motto of "regulate, advocate, and educate" and then turn around and do the exact opposite. I came to them for help in a time of need and they left me to fend for myself."
The Kansas Insurance Department has a mission to "fairly regulate the insurance industry, educate Kansans about insurance and securities, and advocate on behalf of Kansans." However, in this case, the department failed to live up to its mission.
LuPardus' case is just one example of how the Kansas Insurance Department is not doing enough to help Kansans. In recent years, there have been numerous complaints about the department's lack of responsiveness and its failure to resolve claims.
In 2022, the Kansas Insurance Department received more than 1,000 complaints from Kansans. Of those complaints, only a small percentage were resolved.
The Kansas Insurance Department needs to do more to help Kansans. The department needs to be more responsive to complaints and it needs to do a better job of resolving claims.
Kansans deserve better than the Kansas Insurance Department is currently providing.
