Mr. Charles Thomas II,
As you are aware, on August 12th 2022 Homesite Insurance denied my claim ending in 6870 for the following reasons:
"You have violated the below cited policy conditions in the following respects:
1. You have failed to complete the Sworn Statement Proof of Loss correctly and completely.
2. The item claimed are considered marital property as they were purchased during the marriage. As the facts have been presented Lonnie LuPardus is alleging that Greg Yingst deprived Mr. LuPardus of his property.
3. The policy does not provide coverage for theft committed by an "insured". Please see below language." -Homesite Insurance, Jeanne Kettner, Adjuster - August 12th 2022
On December 1st, 2022, Branch Manager Ann Pfefferle responded to an question asked by the insured which stated:
This is not a reason that is listed on the denial given on August 12th 2022, nor has there been any evidence provided by the Insurer to back their alleged claims. The Insurer is in breach of contract and has violated the following laws of Kansas:
Under K.A.R. 40-1-34; Section 7. Standards for Prompt Investigation of Claims: Section A. Within 15 working days after receipt by the insurer of properly executed proofs of loss, the first party claimant shall be advised of the acceptance or denial of the claim by the insurer. No insurer shall deny a claim on the grounds of a specific policy provision, condition, or exclusion unless reference to such provision, condition, or exclusion is included in the denial. The denial must be given to the claimant in writing and the claim file of the insurer shall contain a copy of the denial. B. If a claim is denied for reasons other than those described in paragraph (a) [Section 5. Misrepresentation of Policy Provisions A. No insurer shall fail to fully disclose to first party claimants all pertinent benefits, coverages or other provisions of an insurance policy or insurance contract under which a claim is presented] and is made by any other means than writing, an appropriate notation shall be made in the claim file of the insurer
Petitioner request the Kansas Insurance Department, whom has stated to be devoted to assisting Citizens of Kansas, investigate this complaint and hold Progressive Home by Homesite accountable for this clear violation of Kansas Law
This complaint has been publicly posted on Blogger.com in order to show how Kansas Citizens will be treated when they seek out the Department of Insurances' assistance. I will update any response I receive directly in the blog.
